해상교통안전법 제20조(권리와 의무의 승계)

① 안전진단대행업자로 등록한 자가 그 영업을 양도하거나 법인이 합병한 경우에는 그 양수인 또는 합병 후에 존속하는 법인이나 합병으로 설립되는 법인은 그 등록에 따른 권리와 의무를 승계한다.

(1) Where웨어 a어 person퍼슨 registered^r레지스터드 as애즈 a어 safety세이^f프티 diagnosis다이어그노우시스 agent에이전트 transfers트^r랜스^f퍼즈 the^ð더 business비즈니스 or오 a어 corporation코퍼^r레이션 merges,머지즈 the^ð더 transferee트^r랜스^f퍼^r리 or오 the^ð더 corporation코퍼^r레이션 surviving서^v바이^v빙 the^ð더 merger머저 or오 established이스태블리시트 by바이 the^ð더 merger머저 shall섈 succeed석시드 to투 the^ð더 rights^r라잇츠 and앤드 obligations아블러게이션즈 arising어^r라이징 from^f프^r럼 the^ð더 registration.^r레지스트^r레이션

② 제1항에 따라 권리와 의무를 승계한 자는 승계한 날부터 30일 이내에 해양수산부령으로 정하는 바에 따라 해양수산부장관에게 신고하여야 한다.

(2) A어 person퍼슨 who후 has해즈 succeeded석시디드 to투 rights^r라잇츠 and앤드 obligations아블러게이션즈 under언더 paragraph패^r러그^r래^f프 (1) shall섈 report^r리포트 to투 the^ð더 Minister미너스터 of어^v브 Oceans오우션즈 and앤드 Fisheries^f피셔^r리즈 within위^ð딘 30 days데이즈 from^f프^r럼 the^ð더 date데잇 of어^v브 succession,석세션 as애즈 prescribed프^r리스크^r라이브드 by바이 Ordinance오더넌스 of어^v브 the^ð더 Ministry미너스트^r리 of어^v브 Oceans오우션즈 and앤드 Fisheries.^f피셔^r리즈

③ 해양수산부장관은 제2항에 따른 신고를 받은 날부터 3일 이내에 신고수리 여부를 신고인에게 통지하여야 한다.

(3) The^ð더 Minister미너스터 of어^v브 Oceans오우션즈 and앤드 Fisheries^f피셔^r리즈 shall섈 notify노우터^f파이 the^ð더 reporter^r리포터 of어^v브 whether웨^ð더 the^ð더 report^r리포트 is이즈 accepted액셉티드 within위^ð딘 three^θ쓰^r리 days데이즈 from^f프^r럼 the^ð더 date데잇 of어^v브 receiving^r러시^v빙 a어 report^r리포트 under언더 paragraph패^r러그^r래^f프 (2).

④ 해양수산부장관이 제3항에서 정한 기간 내에 신고수리 여부 또는 민원 처리 관련 법령에 따른 처리기간의 연장 여부를 신고인에게 통지하지 아니하면 그 기간(민원 처리 관련 법령에 따라 처리기간이 연장 또는 재연장된 경우에는 해당 처리기간을 말한다)이 끝난 날의 다음 날에 신고를 수리한 것으로 본다.

(4) Where웨어 the^ð더 Minister미너스터 of어^v브 Oceans오우션즈 and앤드 Fisheries^f피셔^r리즈 fails^f페일즈 to투 notify노우터^f파이 the^ð더 reporter^r리포터 of어^v브 whether웨^ð더 the^ð더 report^r리포트 is이즈 accepted,액셉티드 or오 of어^v브 an앤 extension익스텐션 of어^v브 the^ð더 processing프^r라세싱 period피^r리어드 under언더 statutes스태춧츠 relating^r릴레이팅 to투 the^ð더 handling핸들링 of어^v브 civil시^v블 petitions,퍼티션즈 within위^ð딘 the^ð더 period피^r리어드 under언더 paragraph패^r러그^r래^f프 (3), the^ð더 report^r리포트 shall섈 be비 deemed딤드 accepted액셉티드 on안 the^ð더 day데이 following^f팔로잉 the^ð디 expiration엑스퍼^r레이션 of어^v브 that^ð댓 period피^r리어드 (or,오 where웨어 the^ð더 processing프^r라세싱 period피^r리어드 has해즈 been빈 extended익스텐디드 or오 re-extended^r레이-익스텐디드 under언더 statutes스태춧츠 relating^r릴레이팅 to투 the^ð더 handling핸들링 of어^v브 civil시^v블 petitions,퍼티션즈 that^ð댓 processing프^r라세싱 period).피^r리어드

⑤ 제1항에 따라 안전진단대행업을 승계한 자에 관하여는 제19조를 준용한다.
