법 제42조에 따른 손해금은 공사가 신용보증채무를 이행한 금액에 연 100분의 20을 초과하지 아니하는 범위에서 금융기관의 연체대출금 이율을 고려하여 이사회가 정하는 요율을 곱하여 산출한 금액으로 한다.
