한국자산관리공사 설립 등에 관한 법률 제45조의2(경매에 대한 통지 또는 송달의 특례)

① 제26조제1항 또는 제2항의 업무를 수행할 때 채권자 또는 채권 회수 수임인(受任人)으로서의 공사의 신청에 의하여 법원이 진행하는 「민사집행법」에 따른 경매절차(담보권 실행을 위한 경매절차만 해당한다)에서의 통지 또는 송달은 경매 신청 당시 해당 부동산의 등기부에 적혀 있는 주소(「주민등록법」에 따른 주민등록표에 적혀 있는 주소와 다른 경우에는 주민등록표에 적혀 있는 주소를 포함하며, 주소를 법원에 신고한 경우에는 그 주소로 한다)에 발송함으로써 송달된 것으로 본다. 다만, 등기부 및 주민등록표에 주소가 적혀 있지 아니하고 주소를 법원에 신고하지 아니한 경우에는 공시송달(公示送達)의 방법으로 하여야 한다. <개정 2021.8.17>

② 제1항에 따른 경매절차에서 제26조제1항 또는 제2항의 업무를 수행할 때 채권자 또는 채권 회수 수임인으로서의 공사는 경매 신청 전에 경매실행 예정 사실을 해당 채무자 및 소유자에게 부동산의 등기부에 적혀 있는 주소(「주민등록법」에 따른 주민등록표에 적혀 있는 주소와 다른 경우에는 주민등록표에 적혀 있는 주소를 포함한다)로 통지하여야 한다. 이 경우 발송함으로써 송달된 것으로 본다. <개정 2021.8.17>
