한국산업은행법 제34조(감독)

① 금융위원회는 한국산업은행에 대하여 이 법에서 정하는 바에 따라 감독하고 이에 필요한 명령을 할 수 있으며, 대통령령으로 정하는 바에 따라 경영의 건전성 확보를 위한 감독을 수행하고 이에 필요한 명령을 할 수 있다.

② 금융위원회는 한국산업은행이 제1항에 따른 명령을 위반하여 한국산업은행의 건전한 경영을 해칠 우려가 있다고 인정되는 경우, 「금융소비자 보호에 관한 법률」 제51조제1항제4호, 제5호 또는 같은 조 제2항 각 호 외의 부분 본문 중 대통령령으로 정하는 경우에 해당하는 경우(제2호에 해당하는 조치로 한정한다)에는 다음 각 호의 어느 하나에 해당하는 조치를 할 수 있다. <개정 2020.3.24>

③ 금융위원회는 한국산업은행의 임원이 제1항에 따른 명령을 고의로 위반하거나 한국산업은행의 건전한 경영을 크게 해치는 행위를 하는 경우에는 그 임원의 해임, 직무정지, 경고 및 주의 등 적절한 조치를 할 수 있다.

④ 금융위원회는 한국산업은행의 직원이 제1항에 따른 명령을 고의로 위반하거나 한국산업은행의 건전한 경영을 크게 해치는 행위를 하는 경우에는 한국산업은행 회장에게 면직, 정직, 감봉, 견책, 주의 등 적절한 징계처분을 할 것을 요구할 수 있다.

⑤ 금융위원회는 한국산업은행의 퇴임한 임원 또는 퇴직한 직원이 재임 또는 재직 중이었더라면 제3항과 제4항에 따른 조치를 받았을 것으로 인정되는 경우에는 그 조치의 내용을 한국산업은행 회장에게 통보할 수 있다.

⑥ 제5항에 따른 통보를 받은 한국산업은행 회장은 이를 퇴직한 해당 임직원에게 통보하고, 인사기록부에 기록ㆍ유지하여야 한다.
