학교용지 확보 등에 관한 특례법 제4조의2(학교시설에 관한 특례)

① 제4조제3항제1호 각 목에 따른 개발사업시행자가 「수도권정비계획법」 제2조제1호에 따른 수도권에서 학교용지를 무상으로 공급하는 개발사업을 하는 경우 소공원 및 조경녹지를 포함한 학교시설을 설치하여 시ㆍ도 교육비특별회계 소관 공유재산으로 시ㆍ도 교육청에 무상공급하여야 한다.

② 제1항에 따라 학교시설을 설치하는 개발사업시행자는 학교의 수ㆍ규모, 학교부지에 설치하는 소공원 및 조경녹지, 개교시기 및 설립비용 등에 관하여 교육감과 협의하여야 한다.

③ 제1항에 따라 학교시설을 설치하는 개발사업시행자는 해당 개발지역에 「도시공원 및 녹지 등에 관한 법률」 제14조제2항에도 불구하고 같은 항에 따른 기준면적에서 개발사업면적의 최대 100분의 1을 뺀 면적을 도시공원 또는 녹지로 확보할 수 있다.

④ 제3항에 따라 도시공원 및 녹지를 축소함에 따라 발생하는 개발이익은 학교시설의 설치비용으로 사용하여야 한다.

(4) Development디^v벨럽먼트 gains게인즈 arising어^r라이징 from^f프^r럼 reducing^r러두싱 urban얼븐 parks파크스 and앤드 green그^r린 areas에^r리어즈 under언더 paragraph패^r러그^r래^f프 (3) shall섈 be비 used유즈드 for^f포 the^ð더 costs카스츠 of어^v브 installing인스톨링 school스쿨 facilities.^f퍼실러티즈

⑤ 제1항에 따라 학교시설을 설치하는 경우 그 비용이 제4항에 따른 개발이익보다 많을 경우 제2항에 따른 협의를 통하여 그 차액을 확정하고 교육감이 분담한다.

⑥ 제1항에 따른 학교시설 무상공급 대상에 포함되지 아니하는 개발사업시행자가 학교시설을 설치하여 무상으로 공급하는 경우에는 제2항부터 제4항까지의 규정을 준용한다.
