학교시설사업 촉진법 제14조(분묘등의 정리)

① 감독청(국가나 지방자치단체가 사업시행자인 경우에는 해당 사업시행자를 말한다. 이하 이 조에서 같다)은 학교시설사업을 시행하기 위하여 필요하다고 인정하면 학교시설사업 시행지 안의 분묘ㆍ비(碑) 및 이에 딸린 시설(이하 "분묘등"이라 한다)에 대하여 그 매장자ㆍ소유자 또는 관리인이나 그 연고자(이하 "연고자등"이라 한다)에게 이장(移葬)이나 이전을 명할 수 있다.

② 감독청은 제1항에 따른 분묘등의 연고자등이 이장 또는 이전 명령에 따르지 아니하면 「행정대집행법」으로 정하는 바에 따라 대집행(代執行)할 수 있다.

③ 제1항의 경우 연고자등을 알 수 없는 분묘등이 있으면 감독청은 일정 기간 내에 분묘등을 이장하거나 이전할 것을 공고하여야 하며, 기간 내에 분묘등을 이장하거나 이전하지 아니하면 감독청이 이장하거나 이전할 수 있다.

④ 감독청은 제1항에 따른 분묘등의 이장 또는 이전 명령에 따라 이장하거나 이전하는 자에게 그 비용을 지급하여야 한다.

⑤ 제2항에 따른 대집행 비용과 제3항에 따른 이장 또는 이전 비용 및 제4항에 따른 비용은 사업시행자가 부담한다.

⑥ 사업시행자는 분묘등의 정리를 위한 계획을 시행계획에 포함시켜야 한다.
