학교시설사업 촉진법 제13조(준공검사 등)

① 사업시행자(국가나 지방자치단체인 사업시행자는 제외한다)는 학교시설사업을 마치면 대통령령으로 정하는 바에 따라 감독청에 신고하고 준공검사를 받아야 하며, 제4조제1항 단서에 따라 학교시설의 건축등을 하는 자가 이를 마치면 감독청으로부터 사용승인을 받아야 한다.

② 감독청은 제1항 전단에 따라 신고를 받으면 준공검사를 실시하고 준공검사에 합격한 학교시설에 대하여는 그 결과를 제5조 각 호의 해당 사항의 소관 행정기관의 장 및 시장ㆍ군수ㆍ구청장에게 각각 통보하고 이를 고시하여야 하며, 제1항 후단에 따라 사용승인을 한 경우에는 사용승인서를 발급하고 이를 제5조 각 호의 해당 사항의 소관 행정기관의 장 및 시장ㆍ군수ㆍ구청장에게 각각 통보하여야 한다.

③ 국가나 지방자치단체는 학교시설사업을 마치면 이에 관한 사항을 제5조 각 호의 해당 사항의 소관 행정기관의 장 및 시장ㆍ군수ㆍ구청장에게 각각 통보하고 고시하여야 한다. 다만, 제4조제1항 단서에 따라 학교시설의 건축등을 완료한 경우에는 이를 고시하지 아니한다.

④ 감독청이 제2항에 따라 준공검사의 결과를 고시하거나 사용승인서를 발급하고 이를 통보하면 해당 학교시설이 「건축법」 제22조에 따른 사용검사에 합격된 것으로 보며, 국가나 지방자치단체가 제3항에 따라 학교시설사업의 완료에 관한 사항을 시장ㆍ군수ㆍ구청장에게 통보하면 「건축법」 제29조제3항 단서에 따라 통보한 것으로 본다. <개정 2008.3.21>

⑤ 시장ㆍ군수ㆍ구청장은 제2항이나 제3항에 따라 통보를 받으면 건축 관계 법령에 따른 건축물대장 또는 공작물관리대장에 해당 사항을 지체 없이 적어야 한다.
