하천편입토지 보상 등에 관한 특별조치법 제2조(적용대상)
Special Measures Act on Compensation for Land Incorporated into Rivers, etc., Article 2 (Scope of Application)
다음 각 호의 어느 하나에 해당하는 경우 중 「하천구역편입토지 보상에 관한 특별조치법」 제3조에 따른 소멸시효의 만료로 보상청구권이 소멸되어 보상을 받지 못한 때에는 특별시장ㆍ광역시장 또는 도지사(이하 "시ㆍ도지사"라 한다)가 그 손실을 보상하여야 한다.
In any of the following cases, where the right to claim compensation has been extinguished owing to expiry of the extinctive prescription under Article 3 of the Special Measures Act on Compensation for Land Incorporated into River Zones and compensation could not be received, the Special Metropolitan City Mayor, Metropolitan City Mayor, or Do Governor (hereinafter referred to as "Mayor/Do Governor") shall compensate for the loss:
1. 법률 제2292호 하천법개정법률의 시행일 전에 토지가 같은 법 제2조제1항제2호가목에 해당되어 하천구역으로 된 경우
1. Where land became a river zone by falling under Article 2 (1) 2 (a) of the River Act before the enforcement date of the Act Amending the River Act (Act No. 2292);
2. 법률 제2292호 하천법개정법률의 시행일부터 법률 제3782호 하천법중개정법률의 시행일 전에 토지가 법률 제3782호 하천법중개정법률 제2조제1항제2호가목에 해당되어 하천구역으로 된 경우
2. Where land became a river zone by falling under Article 2 (1) 2 (a) of the Act Partially Amending the River Act (Act No. 3782) from the enforcement date of the Act Amending the River Act (Act No. 2292) until before the enforcement date of the Act Partially Amending the River Act (Act No. 3782);
3. 법률 제2292호 하천법개정법률의 시행으로 제방으로부터 하천 측에 있던 토지가 국유로 된 경우
3. Where land on the river side of the embankment became State-owned by the enforcement of the Act Amending the River Act (Act No. 2292);
4. 법률 제892호 하천법의 시행일부터 법률 제2292호 하천법개정법률의 시행일 전에 제방으로부터 하천 측에 있던 토지 또는 제방부지가 국유로 된 경우
4. Where land on the river side of the embankment or the embankment site became State-owned from the enforcement date of the River Act (Act No. 892) until before the enforcement date of the Act Amending the River Act (Act No. 2292).
