특수임무유공자 예우 및 단체설립에 관한 법률 제8조(예우받을 권리의 발생 및 소멸)

① 이 법에 따라 예우를 받을 권리는 제6조제1항에 따른 등록 신청을 한 날이 속하는 달부터 발생한다. 다만, 제11조의3제1항에 따른 교육지원, 제70조의2제2항에 따른 보조금 지급 및 제75조의2에 따른 생계지원금 지급을 신청하는 경우에는 그 신청한 날이 속하는 달부터 해당 예우를 받을 권리가 발생한다. <개정 2021.8.17>

② 특수임무유공자, 그 유족 또는 가족이 제7조제1항제1호부터 제3호까지, 제80조제1항 또는 제2항의 어느 하나에 해당하게 되면 그 해당하는 사유가 발생한 날이 속하는 달의 다음 달부터 이 법에 따라 예우를 받을 권리가 소멸된다. 이 경우 특수임무유공자 본인이 제7조제1항제2호 또는 제80조제1항에 해당하게 되면 그 가족이 예우를 받을 권리도 함께 소멸된다.

③ 특수임무유공자, 그 유족 또는 가족이 다음 각 호의 어느 하나에 해당하면 이 법에 따라 예우를 받을 권리가 발생하였던 날로 소급하여 그 권리가 소멸된다. 이 경우 특수임무유공자 본인이 예우를 받을 권리가 소멸된 경우에는 그의 유족 또는 가족이 예우를 받을 권리도 함께 소멸된다.

④ 국가보훈부장관은 제3항 각 호의 어느 하나에 해당하는지를 판정할 때에는 그와 관련된 사실을 조사ㆍ확인하여 보훈심사위원회의 심의ㆍ의결을 거쳐야 한다. <개정 2023.3.4>

⑤ 보상심의위원회의 위원장은 제3항 각 호의 어느 하나에 해당하는 사실을 알게 되면 지체 없이 그 내용을 국가보훈부장관에게 통보하여야 한다. <개정 2023.3.4>
