특별감찰관법 시행령 제7조(감찰종료)

① 특별감찰관은 제6조에 따라 감찰에 착수한 경우에는 신속하게 감찰조사를 진행하여 감찰을 종료하여야 한다.

② 특별감찰관은 신고등으로 접수된 사안이 법 제2조의 비위행위나 법 제5조의 감찰대상자에 해당하지 아니하고 다른 기관의 소관사항에 해당한다고 인정되는 경우에는 해당 기관에 신고등을 이첩하여 종료한다.

③ 특별감찰관은 비위행위에 대한 혐의를 인정하기 어려운 경우에는 감찰을 즉시 종료한다.

④ 특별감찰관은 감찰 결과 범죄혐의가 명백하여 형사처벌이 필요하다고 인정한 때에는 중대범죄수사청장에게 고발하여 종료하고, 범죄행위에 해당한다고 믿을 만한 상당한 이유가 있고 도주 또는 증거인멸 등을 방지하거나 증거확보를 위하여 필요하다고 인정한 때에는 중대범죄수사청장에게 수사의뢰하여 종료한다. <개정 2026.9.29>

⑤ 특별감찰관은 감찰 종료 후 5일(공휴일과 토요일은 제외한다) 이내에 감찰 진행경과, 세부 감찰활동 내역, 감찰결과와 그 이유 등을 서면으로 대통령에게 보고한다.

⑥ 특별감찰관은 감찰 결과 「국가공무원법」이나 그 밖의 법령에 규정된 징계사유에 해당한다고 인정되는 경우에는 해당 소속기관의 장에게 관련 자료를 송부한다.
