토양환경보전법 시행령 제5조의8(정밀조사명령 등)

①특별자치시장ㆍ특별자치도지사ㆍ시장ㆍ군수ㆍ구청장은 법 제11조제3항에 따라 정화책임자에게 토양정밀조사를 실시할 것을 명하는 때에는 토양오염지역의 범위 등을 고려하여 6개월의 범위에서 그 이행기간을 정해야 한다. 다만, 조사지역의 규모 등으로 인하여 부득이하게 이행기간 내에 조사를 하기 어려운 사유가 있는 자에 대해서는 6개월의 범위에서 1회로 한정하여 그 이행기간을 연장할 수 있다. <개정 2011.9.30, 2015.3.24, 2018.11.20, 2021.1.5>

②특별자치시장ㆍ특별자치도지사ㆍ시장ㆍ군수ㆍ구청장은 법 제11조제3항에 따라 정화책임자에게 오염토양(토양오염도가 법 제4조의2에 따른 토양오염우려기준을 넘는 토양을 말한다. 이하 같다)의 정화조치를 명하는 때에는 오염토양의 규모 등을 고려하여 2년의 범위에서 그 이행기간을 정해야 한다. 다만, 정화공사의 규모, 정화공법 등으로 인하여 부득이하게 이행기간 내에 정화조치명령을 이행하기 어려운 사유가 있는 자에 대해서는 매회 1년의 범위에서 2회까지 그 이행기간을 연장할 수 있다. <개정 2011.9.30, 2015.3.24, 2018.11.20, 2021.1.5>
