치료감호 등에 관한 법률 제25조의3(격리 등 제한의 금지)

① 치료감호시설의 장은 피치료감호자 및 피치료감호청구인(이하 "피치료감호자등"이라 한다)이 다음 각 호의 어느 하나에 해당하는 경우가 아니면 피치료감호자등에 대하여 격리 또는 묶는 등의 신체적 제한을 할 수 없다. 다만, 피치료감호자등의 신체를 묶는 등으로 직접적으로 제한하는 것은 제1호의 경우에 한정한다.

② 치료감호시설의 장은 제1항에 따라 피치료감호자등에 대하여 격리 또는 묶는 등의 신체적 제한을 하려는 경우 정신건강의학과 전문의의 지시에 따라야 한다. 다만, 제1항제2호 또는 제3호에 해당하는 경우에는 담당 의사의 지시에 따를 수 있다. <개정 2020.10.20>

③ 제1항 및 제2항에 따라 피치료감호자등을 격리하는 경우에는 해당 치료감호시설 안에서 하여야 한다.

④ 제1항 및 제2항에 따라 피치료감호자등을 신체적으로 제한한 경우에는 그 사유, 제한의 기간 및 해제 시기를 포함한 내용을 대통령령으로 정하는 바에 따라 작성ㆍ보존하여야 한다.
