축산물 위생관리법 제9조(안전관리인증기준)

① 식품의약품안전처장은 가축의 사육부터 축산물의 원료관리ㆍ처리ㆍ가공ㆍ포장ㆍ유통 및 판매까지의 모든 과정에서 인체에 위해(危害)를 끼치는 물질이 축산물에 혼입되거나 그 물질로부터 축산물이 오염되는 것을 방지하기 위하여 총리령으로 정하는 바에 따라 각 과정별로 안전관리인증기준(이하 "안전관리인증기준"이라 한다) 및 그 적용에 관한 사항을 정하여 고시한다.

② 제21조제1항제1호에 따른 도축업의 영업자와 같은 항 제2호에 따른 집유업의 영업자는 안전관리인증기준에 따라 해당 작업장에 적용할 자체안전관리인증기준(이하 "자체안전관리인증기준"이라 한다)을 작성ㆍ운용하여야 한다. 다만, 총리령으로 정하는 섬 지역에 있는 영업자인 경우에는 그러하지 아니하다. <개정 2017.10.24, 2020.4.7>

③ 제21조제1항제3호에 따른 축산물가공업의 영업자 중 총리령으로 정하는 영업자, 같은 항 제3호의2에 따른 식용란선별포장업의 영업자 및 같은 항 제4호에 따른 식육포장처리업의 영업자는 제1항에 따라 식품의약품안전처장이 고시한 안전관리인증기준을 지켜야 한다. <신설 2020.4.7, 2020.12.29>

④ 식품의약품안전처장은 제3항에 따라 안전관리인증기준을 지켜야 하는 영업자와 안전관리인증기준을 준수하고 있음을 인증받기를 원하는 자(제2항 본문에 따른 영업자는 제외한다)가 있는 경우에는 그 준수 여부를 심사하여 해당 작업장ㆍ업소 또는 농장을 안전관리인증작업장ㆍ안전관리인증업소 또는 안전관리인증농장으로 인증할 수 있다. <개정 2020.4.7>

⑤ 「농업협동조합법」에 따른 축산업협동조합 등 총리령으로 정하는 자가 가축의 사육, 축산물의 처리ㆍ가공ㆍ유통 및 판매 등 모든 단계에서 안전관리인증기준을 준수하고 있음을 통합하여 인증받고자 신청하는 경우에는 식품의약품안전처장은 그 신청자와 가축의 출하 또는 원료공급 등의 계약을 체결한 작업장ㆍ업소 또는 농장의 안전관리인증기준 준수 여부 등 인증요건을 심사하여 해당 신청자를 안전관리통합인증업체로 인증할 수 있다. 이 경우 해당 작업장ㆍ업소 또는 농장은 제4항에 따른 안전관리인증작업장ㆍ안전관리인증업소 또는 안전관리인증농장으로 각각 인증받은 것으로 본다. <개정 2020.4.7>

⑥ 제4항 또는 제5항 후단에 따라 안전관리인증작업장ㆍ안전관리인증업소 또는 안전관리인증농장으로 인증을 받거나 받은 것으로 보는 자, 제5항 전단에 따른 안전관리통합인증업체로 인증을 받은 자가 그 인증받은 사항 중 총리령으로 정하는 사항을 변경하려는 경우에는 식품의약품안전처장의 변경 인증을 받아야 한다. <개정 2020.4.7>

⑦ 식품의약품안전처장은 제4항 또는 제5항 후단에 따라 안전관리인증작업장ㆍ안전관리인증업소 또는 안전관리인증농장으로 인증을 받거나 받은 것으로 보는 자, 제5항 전단에 따른 안전관리통합인증업체로 인증을 받은 자 및 제6항에 따라 변경 인증을 받은 자에게 그 인증 또는 변경 인증 사실을 증명하는 서류를 발급하여야 한다. <개정 2020.4.7>

⑨ 제7항에 따른 인증 또는 변경 인증 사실 증명서류를 발급받지 아니한 자는 안전관리인증작업장ㆍ안전관리인증업소ㆍ안전관리인증농장 또는 안전관리통합인증업체(이하 "안전관리인증작업장등"이라 한다)라는 명칭을 사용하지 못한다. <개정 2020.4.7>

⑩ 식품의약품안전처장, 시ㆍ도지사 또는 시장ㆍ군수ㆍ구청장은 안전관리인증기준을 효율적으로 운용하기 위하여 다음 각 호의 어느 하나에 해당하는 자에게 안전관리인증기준 준수에 필요한 기술ㆍ정보를 제공하거나 교육훈련을 실시할 수 있다. <개정 2016.2.3, 2020.4.7>

⑪ 식품의약품안전처장, 시ㆍ도지사 또는 시장ㆍ군수ㆍ구청장은 안전관리인증작업장등으로 인증받은 자에게 시설 개선을 위한 융자사업 등의 우선지원을 할 수 있다. <개정 2020.4.7>
