총포ㆍ도검ㆍ화약류 등의 안전관리에 관한 법률 시행규칙 제43조(화약류제조ㆍ관리보안책임자면허의 갱신)

①법 제28조제4항에 따라 화약류제조보안책임자 면허 또는 화약류관리보안책임자 면허의 갱신을 받으려는 사람은 갱신기간 만료일이 속하는 달의 다음 달 말일까지 별지 제23호서식의 화약류제조(관리)보안책임자 면허 갱신 신청서에 다음 각 호의 서류를 첨부하여 면허관청에 제출하여야 한다. 이 경우 허가관청은「전자정부법」 제36조제1항에 따른 행정정보의 공동이용을 통해 해당 국가기술자격증을 확인하여야 하며, 신청인이 확인에 동의하지 아니하는 경우에는 해당 기술자격을 증명하는 서류를 첨부하도록 하여야 한다. <개정 1989.3.14, 1990.4.2, 1999.7.15, 2004.2.2, 2011.2.22, 2026.1.8>

②면허관청은 화약류제조보안책임자면허 또는 화약류관리보안책임자면허를 갱신한 때에는 구면허증을 회수하고 신면허증을 교부하여야 한다.

③ 제1항에도 불구하고 재해ㆍ질병, 그 밖의 부득이한 사유로 갱신기간 만료일이 속하는 달의 다음 달 말일까지 신청할 수 없는 사람은 그 사유를 명확하게 기재한 서류를 첨부하여 연기신청을 할 수 있다. <신설 2011.2.22, 2026.1.8>

④제3항에 따라 면허갱신 연기신청을 하려는 사람은 갱신기간 만료일이 속하는 달의 다음 달 말일까지 별지 제24호의2서식의 화약류제조(관리)보안책임자 면허갱신 연기 신청서를 면허관청에 제출하여야 하며, 면허갱신의 연기를 받은 사람은 그 사유가 없어진 날부터 3월이내에 면허갱신을 신청하여야 한다. <신설 1990.4.2, 2004.2.2, 2011.2.22, 2026.1.8>

⑤ 허가관청은 제1항에 따른 면허 갱신 신청서를 받은 경우에는 법 제29조에 따른 결격사유에의 해당여부를 확인하여야 한다. <신설 2011.2.22>
