총포ㆍ도검ㆍ화약류 등의 안전관리에 관한 법률 시행규칙 제20조의2(모의총포의 제조신고등)

①법 제11조제3항에 따라 모의총포 등(영 별표 5의2 제1호에 따른 모의총포 및 같은 표 제2호에 따른 발사장치를 말한다. 이하 같다)의 제조를 신고하려는 자는 별지 제8호의2서식의 모의총포 등 제조신고서에 다음 각 호의 서류를 첨부하여 경찰서장에게 제출하여야 한다. 다만, 상속ㆍ유증 및 영업의 양수로 사업을 승계한 경우에는 제1호부터 제3호까지에 해당하는 서류의 제출을 생략할 수 있다. <개정 2004.12.10, 2006.2.22, 2006.9.7, 2013.10.22, 2019.9.19>

②제1항에 따른 신고서를 제출받은 경찰서장은 「전자정부법」 제36조제1항에 따른 행정정보의 공동이용을 통하여 법인의 등기사항증명서(법인인 경우만 해당한다)를 확인하여야 한다. <신설 2006.9.7, 2008.12.5, 2009.9.30, 2010.9.10>

③ 경찰서장은 제1항에 따라 모의총포 등 제조신고서를 접수한 때에는 별지 제8호의3서식의 모의총포 등 제조신고증명서를 신고인에게 발급해야 한다. <개정 2019.9.19>

④ 제3항에 따라 모의총포 등 제조신고증명서를 발급받은 자가 모의총포 등 제조업을 폐지했을 때에는 폐지한 날부터 15일 이내에 그 신고증명서를 제조소의 소재지를 관할하는 경찰서장에게 반납해야 한다. <개정 2019.9.19>
