초ㆍ중등교육법 시행령 제91조의5(자율형 공립고등학교)

① 교육감은 공립의 고등학교를 대상으로 법 제61조에 따라 학교 또는 교육과정을 자율적으로 운영하는 고등학교(이하 "자율형 공립고등학교"라 한다)를 교육부장관이 정하는 절차를 거쳐 지정ㆍ고시할 수 있다. <개정 2013.3.23>

(1) The^ð더 Superintendent수퍼^r런텐던트 of어^v브 Education에저케이션 may,메이 following^f팔로잉 the^ð더 procedures프^r러시저즈 determined디터먼드 by바이 the^ð더 Minister미너스터 of어^v브 Education,에저케이션 designate데저그네잇 and앤드 publicly퍼블리클리 notify,노우터^f파이 from^f프^r럼 among어멍 public퍼블릭 high하이 schools,스쿨즈 high하이 schools스쿨즈 that^ð댓 operate아퍼^r레잇 the^ð더 school스쿨 or오 its잇츠 curriculum커^r리큘럼 autonomously오타노머슬리 under언더 Article아터클 61 of어^v브 the^ð디 Act액트 (hereinafter히^r리내^f프터 referred^r러^f퍼드 to투 as애즈 "autonomous오타너머스 public퍼블릭 high하이 schools").스쿨즈

② 자율형 공립고등학교를 운영하려는 학교의 장은 다음 각 호의 사항이 포함된 신청서를 작성하여 교육감에게 제출하여야 한다.

③ 자율형 공립고등학교는 5년 이내로 지정ㆍ운영하되, 시ㆍ도 교육규칙으로 정하는 바에 따라 5년의 범위에서 연장할 수 있다. <신설 2024.1.23>

④ 교육부장관 및 교육감은 자율형 공립고등학교의 특성화된 교육과정 및 프로그램 개발, 교원 연수 등을 위하여 자율형 공립고등학교로 지정된 기간 동안 필요한 재정을 지원할 수 있다. <개정 2011.12.30, 2013.3.23>

⑤ 제1항부터 제4항까지에서 규정한 사항 외에 자율형 공립고등학교의 지정 및 운영에 필요한 사항은 교육부장관이 정하여 고시한다. <개정 2013.3.23>
