철도안전법 시행령 제48조의2(노면전차의 안전운행 저해행위 등)
Enforcement Decree of the Railroad Safety Act, Article 48-2 (Acts Impeding Safe Operation of Trams, etc.)
① 법 제45조제2항에서 "대통령령으로 정하는 행위"란 다음 각 호의 어느 하나에 해당하는 행위를 말한다.
(1) The term "acts prescribed by Presidential Decree" in Article 45 (2) of the Act means any of the following acts:
1. 깊이 10미터 이상의 굴착
1. Excavation to a depth of 10 meters or more;
2. 다음 각 목의 어느 하나에 해당하는 것을 설치하는 행위
2. Installing any of the following:
가. 「건설기계관리법」 제2조제1항제1호에 따른 건설기계 중 최대높이가 10미터 이상인 건설기계
(a) Construction machinery under Article 2 (1) 1 of the Construction Machinery Management Act with a maximum height of 10 meters or more; and
나. 높이가 10미터 이상인 인공구조물
(b) Artificial structures with a height of 10 meters or more; and
3. 「위험물안전관리법」 제2조제1항제1호에 따른 위험물을 같은 항 제2호에 따른 지정수량 이상 제조ㆍ저장하거나 전시하는 행위
3. Manufacturing, storing, or displaying hazardous materials under Article 2 (1) 1 of the Hazardous Materials Safety Management Act in quantities equal to or exceeding the designated quantity under subparagraph 2 of the same paragraph.
② 법 제45조제2항에 따른 신고절차에 관하여는 제46조제1항부터 제4항까지의 규정을 준용한다. 이 경우 "법 제45조제1항"은 "법 제45조제2항"으로, "철도보호지구"는 "노면전차 철도보호지구의 바깥쪽 경계선으로부터 20미터 이내의 지역"으로 본다.
(2) Article 46 (1) through (4) apply mutatis mutandis to the reporting procedures under Article 45 (2) of the Act. In such cases, "Article 45 (1) of the Act" is deemed "Article 45 (2) of the Act," and "railroad protection zone" is deemed "area within 20 meters from the outer boundary of a tram railroad protection zone."
