1. 소속책임운영기관의 재정수입 중 자체 수입(법 제32조제1항에 따른 세입 중 다른 회계로부터의 전입금을 제외한 나머지 세입의 합계를 말한다. 이하 같다)의 비율이 2분의 1 이상에 해당하는 경우

2. 소속책임운영기관의 재정수입 중 자체 수입의 비율이 2분의 1 미만인 경우로서 자체 수입의 성격, 자체 수입 확대의 잠재성 및 기관 운영의 독립성 등을 고려하여 책임운영기관특별회계로 운영할 필요가 있다고 인정되는 경우
