파산신청인이 채권자가 아닌 때에는 파산절차의 비용을 국고에서 가지급할 수 있다. 예납금이 부족하게 된 때, 법원이 직권으로 파산선고를 한 때 또는 파산신청인이 채권자인 경우 미리 비용을 납부하지 아니하였음에도 불구하고 법원이 파산선고를 한 때에도 같다.
