지역신용보증재단법 제40조(위임 등)

① 제17조제6호 및 제30조제1항에 따른 중소벤처기업부장관의 권한은 그 전부 또는 일부를 시ㆍ도지사에 위임할 수 있다. <개정 2017.7.26>

② 중소벤처기업부장관은 필요하다고 인정하는 경우에는 제36조에 따른 재단에 대한 감독권의 일부를 시ㆍ도지사에게 위임할 수 있다. <개정 2017.7.26>

③ 재단은 그 업무의 일부를 대통령령으로 정하는 바에 따라 금융회사등, 중앙회, 「한국자산관리공사 설립 등에 관한 법률」 제6조에 따른 한국자산관리공사 또는 「신용정보의 이용 및 보호에 관한 법률」 제2조제5호에 따른 신용정보회사에 위탁할 수 있다. <개정 2019.11.26>

④ 중앙회의 회장은 신용보증 업무의 전부 또는 일부를 대통령령으로 정하는 바에 따라 금융회사등, 「한국자산관리공사 설립 등에 관한 법률」 제6조에 따른 한국자산관리공사 또는 「신용정보의 이용 및 보호에 관한 법률」 제2조제5호에 따른 신용정보회사에 위탁할 수 있다. <개정 2019.11.26>

⑤ 제3항 및 제4항에 따라 업무를 수탁한 자는 신의성실의 원칙에 따라 업무를 처리하여야 하며, 그 업무에 대하여 재단 및 중앙회를 갈음하여 모든 재판상 또는 재판 외의 행위를 할 수 있다. 다만, 신용정보회사의 경우에는 재판 외의 행위만 할 수 있다.
