지역 개발 및 지원에 관한 법률 제36조(공공시설의 귀속 등)

① 시행자가 지역개발사업의 시행으로 공공시설을 새로 설치하거나 기존의 공공시설에 대체되는 공공시설을 설치한 경우 그 귀속에 관하여는 「국토의 계획 및 이용에 관한 법률」 제65조 및 제99조를 준용한다. 이 경우 제19조제1항제1호부터 제3호까지의 규정에 해당하는 시행자는 행정청인 시행자로 본다.

② 시행자는 제1항에 따라 공공시설의 관리청이 될 자에 대하여 제23조에 따라 승인받은 실시계획에 따른 사업 시행기간이 만료되기 60일 전에 그 공공시설에 대한 합동검사를 요청할 수 있다. 이 경우 그 요청을 받은 자는 특별한 사유가 없으면 요청에 따라야 한다.

③ 시행자와 제1항에 따라 공공시설의 관리청이 될 자는 제2항에 따른 합동검사를 제23조에 따라 승인받은 사업의 시행기간이 만료되기 전에 완료하여야 한다. 다만, 그 기간 내에 합동검사를 완료하기 어려운 불가피한 사정이 있는 경우에는 그러하지 아니하다.
