지방자치법 시행령 제64조(사무인계)

① 법 제119조에 따라 퇴직하는 지방자치단체의 장은 다음 각 호의 구분에 따른 날에 그 소관 사무의 전부를 새로운 지방자치단체의 장이나 그 직무나 권한을 대행하는 사람에게 인계해야 한다.

② 제1항 각 호 외의 부분에 따라 직무나 권한을 대행하는 사람이 사무를 인계받은 경우 그 직무나 권한을 대행하는 사람은 새로운 지방자치단체의 장이 사무를 인수할 수 있게 될 때에 지체 없이 새로운 지방자치단체의 장에게 소관 사무를 인계해야 한다.
