지방자치법 시행령 제41조(행정사무 감사 또는 조사의 실시)

① 법 제49조에 따른 지방자치단체의 사무에 대한 감사는 그 지방자치단체의 조례에서 정하는 바에 따라 매년 제1차 또는 제2차 정례회의 회기 내에 한다.

② 지방의회는 법 제49조에 따라 해당 지방자치단체의 사무 중 특정 사안에 관한 조사의 발의가 있는 경우에는 그 조사 여부에 관하여 의결한다.

③ 지방의회가 폐회 중이거나 휴회 중인 때에 조사의 발의가 있는 경우에는 지방의회의 집회 또는 재개의 요구가 있는 것으로 본다.

④ 감사 또는 조사는 제43조제4항에 따른 감사 또는 조사 계획서에 따른다.

(4) Audits아덧츠 or오 investigations인^v베스터게이션즈 shall섈 follow^f팔로 the^ð디 audit오딧 or오 investigation인^v베스터게이션 plan플랜 under언더 Article아터클 43 (4).

⑤ 지방의회의원은 감사 또는 조사에 사무보조가 필요한 경우에는 지방의회 사무직원의 보조를 받을 수 있다.
