지방자치법 시행령 제13조(서명 요청절차)

① 주민감사청구대표자는 18세 이상의 주민에게 제15조제1항에 따른 청구인명부에 서명할 것을 요청할 수 있다.

② 주민감사청구대표자가 서명을 요청할 때에는 주민감사청구서나 그 사본과 주민감사청구대표자 증명서나 그 사본을 첨부해야 한다.

③ 주민감사청구대표자는 제1항에 따른 서명요청권을 18세 이상의 주민에게 위임할 수 있다.

④ 주민감사청구대표자는 서명요청권을 위임하려는 경우에는 행정안전부령으로 정하는 서명요청권 위임신고서를 작성하여 주무부장관이나 시ㆍ도지사에게 신고해야 한다.

⑤ 주무부장관이나 시ㆍ도지사는 즉시 행정안전부령으로 정하는 서명요청권 위임신고증을 발급해야 한다.

⑥ 제3항에 따라 서명요청권을 위임받은 수임인이 서명을 요청할 때에는 주민감사청구서나 그 사본, 주민감사청구대표자 증명서나 그 사본과 서명요청권 위임신고증을 첨부해야 한다.

⑦ 제1항 및 제4항에 따른 서명 요청은 제12조제2항에 따른 주민감사청구대표자 증명서 발급일부터 특별시ㆍ통합특별시ㆍ광역시ㆍ특별자치시ㆍ도 및 특별자치도(이하 "시ㆍ도"라 한다)의 경우 6개월 이내, 시ㆍ군ㆍ자치구의 경우 3개월 이내에 이루어져야 한다. 이 경우 서명 요청 기간의 계산과 서명 요청 기간의 제한에 관하여는 「주민조례발안에 관한 법률」 제8조제1항 후단 및 제2항을 따른다. <개정 2026.6.23>
