지방자치단체를 당사자로 하는 계약에 관한 법률 시행령 제97조의2(일괄입찰 등의 입찰 참가자격 사전심사)

① 지방자치단체의 장 또는 계약담당자는 일괄입찰 또는 대안입찰의 경우 입찰 참가자격을 미리 심사하여 일괄입찰 또는 대안입찰에 참가할 수 있는 적격자를 선정할 수 있다. 이 경우 선정된 적격자에게 선정 결과를 통지하여야 한다.

② 지방자치단체의 장 또는 계약담당자는 제1항에 따라 입찰 참가자격을 심사하는 경우에는 계약이행의 난이도, 이행실적, 기술능력, 재무상태, 계약이행의 성실도 및 사회적 신인도 등 계약이행능력을 평가하는 데에 필요한 요소들을 종합적으로 고려하여 행정안전부장관이 정한 기준으로 심사하거나 그 기준의 범위에서 입찰 참가자격의 심사기준을 정할 수 있다. 다만, 지방자치단체의 장 또는 계약담당자는 행정안전부장관이 정한 기준의 범위를 벗어나 달리 정하려는 경우에는 행정안전부장관과 미리 협의하여 달리 심사기준을 정할 수 있다. <개정 2013.3.23, 2014.11.19, 2017.7.26>

③ 지방자치단체의 장 또는 계약담당자는 입찰 전에 입찰에 참가하려는 자가 열람할 수 있도록 다음 각 호의 서류를 갖춰 두어야 하며, 입찰에 참가하려는 자가 요구하는 경우에는 이를 내주어야 한다. 이 경우 지정정보처리장치에 이를 게재함으로써 열람 및 교부를 갈음할 수 있다.

④ 지방자치단체의 장 또는 계약담당자는 제2항에도 불구하고 용역 등에 대하여 관계 법령에서 사업자 선정절차 등을 규정하고 있는 경우에는 그 절차 등에 따라 입찰에 참가할 수 있는 적격자를 선정할 수 있다.
