Enforcement Decree of the Act on Contracts to Which a Local Government Is a Party, Article 97 (Qualifications to Participate in Turnkey Bidding, etc.)

① 지방자치단체의 장 또는 계약담당자는 다음 각 호의 요건을 모두 갖춘 자에 한정하여 일괄입찰 또는 대안입찰에 참가하게 하여야 한다. 다만, 제1호와 제2호의 요건 중 어느 하나만을 갖춘 자들이 공동으로 다음 각 호의 요건을 모두 갖추어 일괄입찰 또는 대안입찰에 참가하려는 경우에는 이들의 입찰참가를 허용하여야 한다. <개정 2014.5.22, 2020.1.7, 2021.9.14>

② 지방자치단체의 장 또는 계약담당자는 제1항에도 불구하고 대안입찰의 경우 대안을 제출하지 아니하고 원안에 의한 입찰을 하는 자에 대해서는 제1항제1호의 요건만을 갖춘 자에 대해서도 입찰에 참가하게 하여야 한다.
