지방자치단체를 당사자로 하는 계약에 관한 법률 시행령 제75조(그 밖에 계약내용의 변경으로 인한 계약금액의 조정)

① 지방자치단체의 장 또는 계약담당자는 법 제22조제1항에 따라 공사, 제조 등의 계약에서 제73조와 제74조에 따른 경우 외에 공사기간ㆍ운반거리의 변경 등 계약내용의 변경으로 계약금액을 조정하여야 할 필요가 있는 경우에는 그 변경된 내용에 따라 실비를 초과하지 아니하는 범위에서 조정한다. <개정 2019.6.25>

② 지방자치단체의 장 또는 계약담당자는 단순한 노무에 의한 용역계약으로서 행정안전부령으로 정하는 용역계약에 대해서는 「최저임금법」에 따른 최저임금액이 변동되어 당초의 계약금액(제73조제8항에 따라 계약금액 조정을 하는 경우를 포함한다)으로는 최저임금 지급이 곤란하다고 인정하는 경우로서 행정안전부장관이 정하는 요건에 해당하는 경우에는 계약금액을 조정한다. <신설 2019.6.25>
