지방자치단체를 당사자로 하는 계약에 관한 법률 시행령 제32조의2(구매규격 사전공개)

① 지방자치단체의 장 또는 계약담당자는 법 제9조의2제1항 본문에 따라 구매규격을 사전공개 하는 경우 지정정보처리장치를 통하여 5일간 공개한다. 다만, 긴급한 경우에는 3일간 공개한다.

② 법 제9조의2제1항 단서에서 "긴급 수요물자ㆍ비밀물자 또는 추정가격이 5천만원 미만인 물품ㆍ용역 등 대통령령으로 정하는 물품이나 용역"이란 다음 각 호의 어느 하나에 해당하는 물품이나 용역을 말한다.

③ 지방자치단체의 장 또는 계약담당자는 관련 업체가 구매규격 사전공개와 관련하여 법 제9조의2제1항에 따라 의견을 제출하는 경우, 그 의견을 받은 날부터 14일 이내에 그 내용을 검토하여 필요한 조치를 하고 지체 없이 그 결과를 의견을 제출한 자에게 통지하여야 한다. 다만, 제출된 의견이 제108조제1항 각 호의 어느 하나에 해당하는 계약에 관한 것이면 법 제32조에 따른 계약심의위원회의 심의를 거쳐 의견을 제출받은 날부터 50일 이내에 통지하여야 한다.
