지방자치단체를 당사자로 하는 계약에 관한 법률 시행령 제23조(지명입찰대상자의 지명)

① 지방자치단체의 장 또는 계약담당자는 제22조에 따라 지명입찰에 부치려는 경우에는 5인 이상의 입찰대상자를 지명하여 2인 이상의 입찰 참가신청을 받아야 한다. 다만, 지명대상자가 5인 미만일 때에는 대상자를 모두 지명하여야 한다.

② 제1항의 경우에는 제36조 각 호의 사항을 각 입찰대상자에게 통지함으로써 입찰공고를 갈음한다. 이 경우 입찰공고일은 통지일로 보며, 통지시기에 관하여는 제35조를 준용한다.

③ 지방자치단체의 장 또는 계약담당자는 제1항에 따라 입찰대상자를 지명하려는 경우에는 행정안전부령으로 정하는 바에 따라 이를 통지하고 입찰참가 여부를 확인하여야 한다. <개정 2013.3.23, 2014.11.19, 2017.7.26>
