② 법 제34조제1항제6호에서 "대통령령으로 정하는 사항"이란 법 제5조에 따른 국제입찰에 있어서 정부가 가입하거나 체결한 다자간 또는 양자간 정부조달협정(국제협정에 포함된 정부조달부분을 포함한다. 이하 "협정"이라 한다)에 위배된 사항, 법 제6조제1항에 따른 계약의 원칙을 위반하여 계약상대자의 계약상 이익을 부당하게 제한하는 특약이나 조건을 정한 사항, 법 제30조의2에 따른 계약의 해제ㆍ해지 등과 관련된 사항과 제73조부터 제75조까지 및 제75조의2에 따라 물가 변동, 설계 변경, 그 밖에 계약내용의 변경 및 계약기간의 연장으로 인한 계약금액의 조정, 제90조에 따른 지연배상금, 계약기간의 연장과 관련된 사항을 말한다. <개정 2011.9.15, 2019.6.25, 2025.7.8>
