지방교육재정교부금법 제8조(교부금의 조정 등)

① 교부금이 산정자료의 착오 또는 거짓으로 인하여 부당하게 교부되었을 때에는 교육부장관은 해당 시ㆍ도가 정당하게 받을 수 있는 교부금액을 초과하는 금액을 다음에 교부할 교부금에서 감액한다.

② 지방자치단체가 법령을 위반하여 지나치게 많은 경비를 지출하였거나 확보하여야 할 수입의 징수를 게을리하였을 때에는 교육부장관은 그 지방자치단체에 교부할 교부금을 감액하거나 이미 교부한 교부금의 일부를 반환할 것을 명할 수 있다. 이 경우 감액하거나 반환을 명하는 교부금의 금액은 법령을 위반하여 지출하였거나 징수를 게을리하여 확보하지 못한 금액을 초과할 수 없다.
