지방공무원법 제43조의3(채용 비위 관련자의 합격 등 취소)

① 시험실시기관의 장 또는 임용권자는 누구든지 공무원 채용과 관련하여 대통령령으로 정하는 비위를 저질러 유죄판결이 확정된 경우에는 그 비위행위로 인하여 채용시험에 합격하거나 임용된 사람에 대하여 대통령령으로 정하는 바에 따라 합격 또는 임용을 취소할 수 있다. 이 경우 취소 처분을 하기 전에 미리 그 내용과 사유를 당사자에게 통지하고 소명할 기회를 주어야 한다.
