지방공기업법 제64조의2(회계처리의 원칙 등)

① 공사는 경영 성과 및 재무 상태를 명확히 하기 위하여 회계거래를 발생 사실에 따라 기업회계기준에 따라 회계처리한다.

③ 공사가 계약을 체결하려는 경우에는 일반경쟁의 방식으로 하여야 한다. 다만, 계약의 목적ㆍ성질 및 규모 등을 고려하여 참가자의 자격을 제한하거나 참가자를 지명하여 경쟁에 부치거나 수의계약으로 할 수 있다. <신설 2013.6.4>

④ 공사는 계약을 체결하는 경우 공정한 경쟁 또는 계약의 적정한 이행을 해칠 것이 명백하다고 판단되는 자에 대하여는 2년 이내의 범위에서 입찰참가자격을 제한할 수 있다. <개정 2013.6.4>

⑤ 공사는 제4항에 따라 입찰참가자격을 제한받은 자와 수의계약을 체결하여서는 아니 된다. 다만, 제4항에 따라 입찰참가자격을 제한받은 자 외에는 적합한 시공자ㆍ제조자가 존재하지 아니하는 등 부득이한 사유가 있는 경우에는 그러하지 아니하다. <개정 2013.6.4>

⑥ 제1항부터 제5항까지의 규정에 따른 회계처리, 계약의 기준 및 절차, 입찰참가자격의 제한 등에 관하여 필요한 사항은 대통령령으로 정한다. <개정 2013.3.23, 2013.6.4>
