주택법 시행령 제39조(간선시설의 설치 등)

① 법 제28조제1항 각 호 외의 부분 본문에서 "대통령령으로 정하는 호수"란 다음 각 호의 구분에 따른 호수 또는 세대수를 말한다.

② 법 제28조제1항 각 호 외의 부분 본문에서 "대통령령으로 정하는 면적"이란 1만6천500제곱미터를 말한다.

③ 사업계획승인권자는 제1항 또는 제2항에 따른 규모 이상의 주택건설 또는 대지조성에 관한 사업계획을 승인하였을 때에는 그 사실을 지체 없이 법 제28조제1항 각 호의 간선시설 설치의무자(이하 "간선시설 설치의무자"라 한다)에게 통지하여야 한다.

④ 간선시설 설치의무자는 사업계획에서 정한 사용검사 예정일까지 해당 간선시설을 설치하지 못할 특별한 사유가 있을 때에는 제3항에 따른 통지를 받은 날부터 1개월 이내에 그 사유와 설치 가능 시기를 명시하여 해당 사업주체에게 통보하여야 한다.

⑤ 법 제28조제6항에 따른 간선시설의 종류별 설치범위는 별표 2와 같다.
