주차장법 시행령 제12조의5(기계식주차장치의 철거)

①법 제19조의13제1항제1호에서 "대통령령으로 정하는 기간"이란 5년을 말한다. <개정 2016.7.19>

② 특별시장ㆍ광역시장, 시장ㆍ군수 또는 구청장은 법 제19조의13제6항에 따라 기계식주차장의 수급 실태 및 이용 특성 등을 고려하여 기계식주차장치의 철거가 필요하다고 인정하는 경우에는 해당 지방자치단체의 조례로 정하는 바에 따라 별표 1에 따른 부설주차장 설치기준을 철거되는 기계식주차장치의 종류별로 2분의 1의 범위에서 완화할 수 있다. <신설 2016.7.19, 2026.8.25>

③ 제2항에 따라 완화된 부설주차장 설치기준에 따라 설치한 주차장의 경우 해당 시설물이 증축되거나 부설주차장 설치기준이 강화되는 용도로 변경될 때에는 그 증축 또는 용도변경하는 부분에 대해서는 제2항에도 불구하고 별표 1에 따른 부설주차장 설치기준을 적용한다. <신설 2016.7.19>
