주차장법 시행령 제12조의3(기계식주차장의 사용검사 등)

① 법 제19조의9제2항에 따른 사용검사의 유효기간은 3년으로 하고, 정기검사의 유효기간은 2년으로 한다. <개정 2016.1.19>

② 제1항에도 불구하고 사용검사 또는 정기검사의 유효기간 만료 전에 법 제19조의23제1항 각 호에 따라 정밀안전검사를 받은 경우 정밀안전검사를 받은 날부터 다음 정기검사의 유효기간을 기산한다. <신설 2018.2.20, 2018.10.23>

③ 제1항에 따른 정기검사의 검사기간은 사용검사 또는 정기검사의 유효기간 만료일 전후 각각 31일 이내로 한다. 이 경우 해당 검사기간 이내에 적합판정을 받은 경우에는 사용검사 또는 정기검사의 유효기간 만료일에 정기검사를 받은 것으로 본다. <신설 2016.1.19, 2018.2.20>

④ 법 제19조의9제1항에 따라 기계식주차장을 설치한 자 또는 해당 기계식주차장의 관리자(이하 "기계식주차장관리자등"이라 한다)는 기계식주차장치의 주요구동부의 부품, 운반기 및 철골을 변경한 경우에는 해당 주차장을 사용하기 전에 같은 조 제2항제3호가목에 따른 수시검사를 요청해야 한다. <신설 2024.8.16>

⑤ 법 제19조의9제2항 각 호 외의 부분 단서에서 "대통령령으로 정하는 부득이한 사유"란 다음 각 호의 경우를 말한다. <개정 2016.1.19, 2018.2.20, 2024.8.16>

⑥ 제5항 각 호에 따른 사유로 정기검사 또는 법 제19조의9제2항제3호나목에 따른 수시검사를 연기하려는 자는 국토교통부령으로 정하는 바에 따라 다음 각 호에 따른 기한 전에 연기신청을 해야 한다. <개정 2024.8.16>

⑦ 제6항에 따라 정기검사를 연기한 자는 해당 사유가 없어졌을 때에는 그때부터 2개월 이내에 정기검사를 받아야 한다. 이 경우 정기검사가 끝날 때까지 사용검사 또는 정기검사의 유효기간이 연장된 것으로 본다. <개정 2016.1.19, 2018.2.20, 2024.8.16>

⑧ 제6항에 따라 법 제19조의9제2항제3호나목에 따른 수시검사를 연기한 자는 해당 사유가 없어졌을 때에는 지체 없이 수시검사를 받아야 한다. <신설 2024.8.16>
