주식회사 등의 외부감사에 관한 법률 제13조(감사인의 해임)

① 감사인이 「공인회계사법」 제21조 또는 제33조를 위반한 경우 회사는 지체 없이 감사인과의 감사계약을 해지하여야 하며, 감사계약을 해지한 후 2개월 이내에 새로운 감사인을 선임하여야 한다.

② 제10조제3항에도 불구하고 주권상장법인, 대형비상장주식회사 또는 금융회사는 연속하는 3개 사업연도의 동일 감사인으로 선임된 감사인이 직무상 의무를 위반하는 등 대통령령으로 정하는 사유에 해당하는 경우에는 연속하는 3개 사업연도 중이라도 매 사업연도 종료 후 3개월 이내에 다음 각 호의 구분에 따라 해임요청된 감사인을 해임하여야 한다. 이 경우 회사는 감사인을 해임한 후 2개월 이내에 새로운 감사인을 선임하여야 한다.

③ 주권상장법인, 대형비상장주식회사 또는 금융회사는 제1항 또는 제2항에 따라 감사계약을 해지하거나 감사인을 해임한 경우에는 지체 없이 그 사실을 증권선물위원회에 보고하여야 한다.
