주민등록법 제10조의3(해외체류에 관한 신고)

① 이 법에 따라 주민등록을 한 거주자 또는 제20조제6항에 따라 거주불명으로 등록된 사람(이하 "거주불명자"라 한다)이 90일 이상 해외에 체류할 목적으로 출국하려는 경우(제19조제1항에 따라 국외이주신고를 하여야 하는 사람은 제외한다)에는 출국 후에 그가 속할 세대의 거주지를 제10조제1항제7호에 따른 주소로 미리 신고할 수 있다. 다만, 출국 후 어느 세대에도 속하지 아니하게 되는 사람은 신고 당시 거주지를 관할하는 읍ㆍ면사무소 또는 동 주민센터의 주소를 행정상 관리주소로 신고할 수 있다. <개정 2019.12.3>

② 제1항 본문에 따른 신고는 신고할 주소지를 관할하는 시장ㆍ군수 또는 구청장에게 하고, 제1항 단서에 따른 신고는 신고 당시 거주지를 관할하는 시장ㆍ군수 또는 구청장에게 한다.

③ 제2항의 시장ㆍ군수 또는 구청장은 제1항에 따른 신고를 하고 출국한 사람(이하 "해외체류자"라 한다)의 주민등록을 구분하여 등록ㆍ관리할 수 있다.

④ 제1항부터 제3항까지에 따른 신고의 방법, 첨부서류, 해외체류자의 구분 등록ㆍ관리 등에 관한 구체적인 사항은 대통령령으로 정한다.
