Enforcement Decree of the Special Act on the Establishment of Jeju Special Self-Governing Province and the Development of Free International City, Article 23 (Criteria for Rescinding Designation of Jeju Investment Promotion Zones)
법 제163조제1항에서 "대통령령으로 정하는 기준"이란 다음 각 호의 구분에 따른 기준을 말한다.
The "criteria prescribed by Presidential Decree" in Article 163 (1) of the Act means the criteria according to the following classification:
1. 법 제162조제1항제1호에 해당하여 제주투자진흥지구로 지정된 경우: 같은 조 제2항에 따라 고시된 날부터 5년 이내에 제22조제1항에 따른 기준에 적합한 투자를 완료할 것
1. Where the zone was designated as a Jeju investment promotion zone under Article 162 (1) 1 of the Act: investment conforming to the criteria under Article 22 (1) must be completed within five years from the date of public notice under paragraph (2) of that Article;
2. 법 제162조제1항제2호에 해당하여 제주투자진흥지구로 지정된 경우: 다음 각 목의 기준에 모두 적합할 것
2. Where the zone was designated as a Jeju investment promotion zone under Article 162 (1) 2 of the Act: all of the following criteria must be met:
가. 투자이행기간 내에 제22조제1항에 따른 기준에 적합한 투자를 완료할 것
(a) Investment conforming to the criteria under Article 22 (1) must be completed within the investment implementation period;
나. 제22조제2항에 따른 조건을 충족할 것. 다만, 법령 또는 제주투자진흥지구의 개발 계획에 따른 토지의 매각 등 정당한 사유가 있는 경우에는 같은 항 제3호의 조건은 충족하지 않을 수 있다.
(b) The conditions under Article 22 (2) must be satisfied; provided that, where there are justifiable grounds such as the sale of land under statutes or the development plan of the Jeju investment promotion zone, the condition in subparagraph 3 of that paragraph need not be satisfied.
