Enforcement Decree of the Act on the Improvement of Mental Health and the Support for Welfare Services for Mental Patients, Article 17-2 (Requirements for Guardian Candidates)

법 제38조의3제2항에서 "대통령령으로 정하는 요건을 충족하는 사람 또는 법인"이란 「민법」 제937조에 따른 결격사유가 없는 사람 또는 법인으로서 다음 각 호의 어느 하나에 해당하는 사람 또는 법인을 말한다.

가. 정신건강증진사업 또는 「민법」에 따른 후견인 또는 후견감독인의 사무와 관련된 업무를 수행할 것
