정보통신공사업법 시행령 제8조의3(감리원의 배치기준 등)

① 용역업자는 법 제8조제2항 후단에 따라 다음 각 호의 기준에 따른 감리원을 공사가 시작하기 전에 1명 배치해야 한다. 이 경우 용역업자는 전체 공사기간 중 발주자와 합의한 기간(공사가 중단된 기간은 제외한다)에는 해당 감리원을 공사 현장에 상주하도록 배치해야 한다.

② 용역업자는 제1항에 따라 감리원을 배치한 때에는 그 배치내용을 해당 공사의 발주자에게 통지해야 하며, 배치된 감리원을 교체하려는 경우에는 미리 발주자의 승인을 받아야 한다.

③ 용역업자는 1명의 감리원에게 둘 이상의 공사를 감리하게 해서는 안 된다. 다만, 다음 각 호의 어느 하나에 해당하는 공사로서 발주자의 승낙을 얻은 경우에는 그렇지 않다.

④ 용역업자는 제1항 각 호 또는 제3항제1호의 기준에 따라 감리원을 배치한 이후에 설계변경 또는 물가변동 등의 사유로 총공사금액이 변경되는 경우에는 변경된 총공사금액에 적합하게 감리원을 배치해야 한다. 다만, 최초 총공사금액의 100분의 10 미만의 범위에서 변경되는 경우에는 기존에 배치된 감리원에게 감리업무를 계속 수행하게 할 수 있다.

⑤ 용역업자는 감리원이 감리업무의 수행기간 중 관계법령에 따른 교육을 받거나 질병 또는 유급휴가로 현장을 이탈하게 되는 경우에는 감리업무에 지장이 없도록 필요한 조치를 해야 한다.

⑥ 용역업자는 제1항에 따라 감리원을 배치하려는 경우 발주자와 합의하여 감리원이 공사 현장에 상주해야 하는 기간 및 추가로 배치하려는 감리원 수를 산정할 때 법 제6조제3항제2호에 따른 감리업무 수행기준 또는 「엔지니어링산업 진흥법」 제31조제2항에 따른 엔지니어링사업의 대가 산정기준(표준품셈 등을 말한다)을 이용할 수 있다.
