정보통신공사업법 시행령 제32조(발주자의 하도급대금 직접 지급방법 등)

1. 발주자는 수급인의 지급정지ㆍ파산 등으로 인하여 하도급대금을 지급할 수 없는 사유가 발생한 것을 확인한 때에는 기성부분과 하수급인이 시공한 부분의 금액을 확정한 후 하수급인에게 하도급대금의 직접 지급을 청구할 수 있다는 뜻과 지급할 금액을 통보할 것

2. 하수급인은 제1호의 통보를 받은 날부터 15일 이내에 하도급대금의 직접지급을 청구할 것

4. 발주자는 하도급대금지급의 우선순위를 정하는 때에 하도급대금을 직접 지급받을 하수급인이 다수인 경우에는 하도급공사의 준공 또는 기성순위를 기준으로 하고, 그 시점이 같은 때에는 제2호에 따른 하도급대금의 직접지급청구서의 접수일을 기준으로 할 것
