전통시장 및 상점가 육성을 위한 특별법 제33조(시장정비사업추진계획의 수립)
Special Act on Fostering Traditional Markets and Shopping Districts, Article 33 (Formulation of Market Improvement Project Promotion Plans)
① 시장정비사업추진계획을 승인받으려는 자는 다음 각 호의 사항을 포함한 시장정비사업추진계획(이하 "사업추진계획"이라 한다)을 수립하여 시장ㆍ군수ㆍ구청장에게 사업추진계획 승인에 대한 추천을 신청하여야 한다. <개정 2011.4.14>
(1) A person who intends to obtain approval of a market improvement project promotion plan shall formulate a market improvement project promotion plan (hereinafter referred to as the "project promotion plan") including the following matters and apply to the Mayor/Gun head/Gu head for recommendation for approval of the project promotion plan:
1. 시장정비구역의 범위
1. The scope of the market improvement zone;
2. 시장정비사업의 필요성
2. The necessity of the market improvement project;
3. 다음 각 목의 내용에 대하여 필요한 조치사항
3. Measures necessary for the following:
가. 「국토의 계획 및 이용에 관한 법률」 제2조제4호에 따른 도시ㆍ군관리계획 중 도시ㆍ군계획시설의 결정 또는 변경결정
(a) Decision or change of an urban or Gun planning facility among urban or Gun management plans under Article 2 subparagraph 4 of the National Land Planning and Utilization Act;
나. 「국토의 계획 및 이용에 관한 법률」 제2조제5호에 따른 지구단위계획의 결정 또는 변경결정
(b) Decision or change of a district unit plan under Article 2 subparagraph 5 of the National Land Planning and Utilization Act;
다. 「국토의 계획 및 이용에 관한 법률」 제36조제1항제1호가목 및 다목에 따른 주거지역 및 공업지역의 용도지역에서 대통령령으로 정하는 지역으로의 용도지역 변경
(c) Change of use district from a residential area or industrial area under Article 36 (1) 1 (a) and (c) of the National Land Planning and Utilization Act to an area prescribed by Presidential Decree;
4. 제49조제1항 및 제6항에 따른 입점상인 보호대책
4. Protection measures for entering merchants under Article 49 (1) and (6);
5. 그 밖에 사업추진계획의 검토를 위하여 필요하다고 대통령령으로 정하는 사항
5. Other matters prescribed by Presidential Decree as necessary for reviewing the project promotion plan.
② 제1항에 따라 사업추진계획 승인에 대한 추천을 신청할 수 있는 자는 다음 각 호의 어느 하나에 해당하는 자로 한다.
(2) A person who may apply for recommendation for approval of a project promotion plan under paragraph (1) shall be any of the following:
1. 토지등 소유자(개인이나 법인이 단독으로 소유한 경우만 해당한다)
1. An owner of land, etc. (limited to cases of sole ownership by an individual or corporation);
2. 추진위원회
2. A promotion committee;
3. 토지등 소유자가 시장정비사업을 추진하기 위하여 설립한 법인(이하 "시장정비사업법인"이라 한다)
3. A corporation established by owners of land, etc. to promote a market improvement project (hereinafter referred to as a "market improvement project corporation");
4. 시장ㆍ군수ㆍ구청장(제41조제3항 및 제47조제1항에 따라 시장ㆍ군수ㆍ구청장이 직접 시행하는 경우만 해당한다)
4. The Mayor/Gun head/Gu head (limited to cases of direct implementation by the Mayor/Gun head/Gu head under Article 41 (3) and Article 47 (1));
5. 「한국토지주택공사법」 제2조에 따라 설립한 한국토지주택공사(이하 "한국토지주택공사"라 한다) 또는 「지방공기업법」 제49조에 따라 설립한 지방공사(이하 "지방공사"라 한다). 다만, 제41조제3항에 해당하는 경우만을 말한다.
5. The Korea Land and Housing Corporation established under Article 2 of the Korea Land and Housing Corporation Act (hereinafter referred to as the "Korea Land and Housing Corporation") or a local public corporation established under Article 49 of the Local Public Enterprises Act (hereinafter referred to as a "local public corporation"): Provided, That this shall be limited to cases falling under Article 41 (3).
③ 사업추진계획의 수립 절차와 내용, 시ㆍ군ㆍ구에 제출하는 서류 및 그 밖에 필요한 사항은 대통령령으로 정한다.
(3) The procedures and content for formulating project promotion plans, documents to be submitted to the Si/Gun/Gu, and other necessary matters shall be prescribed by Presidential Decree.
