Act on the Use and Promotion of Electronic Procurement, Article 9 (Preparation of Electronic Contracts and Formation of Contracts)

① 수요기관의 장 또는 계약담당자는 전자조달시스템을 이용하여 계약상대자와 계약을 체결하려는 경우에는 계약의 목적, 계약금액, 이행기간, 계약보증금이나 지연배상금(遲延賠償金)에 관한 사항, 그 밖에 필요한 사항이 입력된 전자적 형태의 계약서(이하 "전자계약서"라 한다)를 전자조달시스템을 통하여 작성하여야 한다.

② 다음 각 호의 순서에 따른 요건을 모두 갖춘 때에는 제1항에 따른 계약이 성립한다.
