전기공사공제조합법 제46조(조합의 책임 등)

① 조합은 조합이 보증한 사항에 관하여 법령, 입찰유의서, 하도급입찰유의서, 도급계약서, 하도급계약서 또는 그 밖의 계약서에서 정하는 바에 따라 보증금을 납입할 사유가 발생한 경우에는 조합원을 갈음하여 그 보증한 금액을 조합의 보증을 받는 상대방(이하 "보증채권자"라 한다)에게 납입하여야 한다.

② 보증채권자가 조합에 대하여 가지는 보증금에 관한 권리는 보증기간이 끝난 날부터 2년간 행사하지 아니하면 시효로 소멸한다.
