재외국민의 가족관계등록 창설, 가족관계등록부 정정 및 가족관계등록부 정리에 관한 특례법 제6조((가족관계등록부의 작성 등))

① 시ㆍ구ㆍ읍ㆍ면의 장(재외국민 가족관계등록사무소의 가족관계등록관을 포함한다)은 가정법원으로부터 가족관계등록 창설허가 또는 가족관계등록부 정정허가의 등본을 접수하였을 때 또는 재외공관의 장의 조사확인서가 첨부된 가족관계등록부 정정허가신청서를 접수하였을 때에는 지체 없이 가족관계등록부를 작성하거나 정정하고 5일 이내에 그 가족관계등록부의 증명서를 외교부장관과 재외공관의 장을 거쳐 신청인에게 송부하여야 한다. <개정 2013.3.23, 2015.2.3>

② 시ㆍ구ㆍ읍ㆍ면의 장(재외국민 가족관계등록사무소의 가족관계등록관을 포함한다)이 직접 또는 재외공관의 장으로부터 가족관계등록부 정리신청서를 접수한 경우에 「가족관계의 등록 등에 관한 법률」에 따라 가족관계등록부를 정리할 수 있을 때에는 지체 없이 이를 정리하고 5일 이내에 그 가족관계등록부의 증명서를 송부하되 신청서를 직접 접수한 경우에는 직접 신청인에게, 외교부장관과 재외공관의 장을 거쳐 접수한 경우에는 외교부장관과 재외공관의 장을 거쳐 신청인에게 송부하여야 한다. 다만, 가족관계등록부를 정리할 수 없는 사유가 있을 때에는 직접 또는 외교부장관과 재외공관의 장을 거쳐 신청인에게 그 사유서와 신청서를 반송하여야 한다. <개정 2013.3.23, 2015.2.3>
