장애인복지법 시행규칙 제43조(시설의 설치ㆍ운영신고 등)

① 법 제59조제2항 본문에 따라 국가 또는 지방자치단체 외의 자가 장애인복지시설을 설치ㆍ운영하려는 경우에는 별지 제20호서식의 신고서(전자문서로 된 신고서를 포함한다)에 다음 각 호의 서류(전자문서를 포함한다)를 첨부하여 관할 시장ㆍ군수ㆍ구청장에게 제출하여야 한다. <개정 2025.7.1>

② 제1항에 따라 신고서를 받은 시장ㆍ군수ㆍ구청장은 「소방시설 설치ㆍ유지 및 안전관리에 관한 법률 시행령」 별표 5에 따라 장애인복지시설이 갖추어야 하는 소방시설에 대하여 「소방시설 설치ㆍ유지 및 안전관리에 관한 법률」 제7조제6항 전단에 따라 그 장애인복지시설의 소재지를 관할하는 소방본부장이나 소방서장에게 그 장애인복지시설이 같은 법 또는 같은 법에 따른 명령을 따르고 있는지에 대한 확인을 요청하여야 하고, 「전자정부법」 제36조제1항에 따른 행정정보의 공동이용을 통하여 다음 각 호의 서류를 확인하여야 한다. <개정 2010.9.1, 2012.4.10, 2015.8.3, 2017.3.28>

③ 법 제59조제2항 본문에 따라 장애인복지시설의 설치ㆍ운영을 신고한 자가 신고한 사항을 변경하려면 다음 각 호에서 정하는 바에 따라 해당하는 서류를 관할 시장ㆍ군수ㆍ구청장에게 제출하여야 한다. <개정 2012.4.10, 2015.8.3>

④ 제3항제2호에 따라 시설 종류의 변경신고서를 받거나 같은 항 제3호에 따라 시설 소재지의 변경신고서를 받은 시장ㆍ군수ㆍ구청장은 「소방시설 설치ㆍ유지 및 안전관리에 관한 법률 시행령」 별표 5에 따라 장애인복지시설이 갖추어야 하는 소방시설에 대하여 「소방시설 설치ㆍ유지 및 안전관리에 관한 법률」 제7조제6항 전단에 따라 그 장애인복지시설의 소재지를 관할하는 소방본부장이나 소방서장에게 그 장애인복지시설이 같은 법 또는 같은 법에 따른 명령을 따르고 있는지를 확인하여 줄 것을 요청하여야 하고, 「전자정부법」 제36조제1항에 따른 행정정보의 공동이용을 통하여 다음 각 호의 서류를 확인하여야 한다. <개정 2010.9.1, 2012.4.10, 2015.8.3>

⑤ 시장ㆍ군수ㆍ구청장은 제1항에 따른 신고를 받으면 별지 제23호서식의 장애인복지시설신고증을 발급하여야 하며, 제3항에 따른 변경신고를 받은 경우에는 장애인복지시설 신고증에 그 변경사항을 적어 발급하여야 한다.

(5) Upon어판 receipt^r리싯 of어^v브 a어 report^r리포트 under언더 paragraph패^r러그^r래^f프 (1), the^ð더 head헤드 of어^v브 a어 Si/Gun/Gu시 shall섈 issue이슈 a어 certificate서티^f피컷 of어^v브 report^r리포트 of어^v브 a어 welfare웰^f페어 facility^f퍼실리티 for^f포 persons퍼슨즈 with위^ð드 disabilities디서빌러티즈 in인 Form^f폼 No.노우 23, and앤드 upon어판 receipt^r리싯 of어^v브 a어 report^r리포트 of어^v브 changes체인지즈 under언더 paragraph패^r러그^r래^f프 (3), shall섈 enter엔터 the^ð더 changes체인지즈 in인 the^ð더 certificate서티^f피컷 of어^v브 report^r리포트 of어^v브 a어 welfare웰^f페어 facility^f퍼실리티 for^f포 persons퍼슨즈 with위^ð드 disabilities디서빌러티즈 and앤드 issue이슈 it.잇

⑥ 시장ㆍ군수ㆍ구청장은 별지 제24호서식의 장애인복지시설신고관리대장을 작성ㆍ관리하여야 한다.

(6) The^ð더 head헤드 of어^v브 a어 Si/Gun/Gu시 shall섈 prepare프^r리페어 and앤드 manage매너지 a어 management매너지먼트 ledger레저 of어^v브 reports^r리포츠 of어^v브 welfare웰^f페어 facilities^f퍼실러티즈 for^f포 persons퍼슨즈 with위^ð드 disabilities디서빌러티즈 in인 Form^f폼 No.노우 24.
