장애인기업활동 촉진법 시행령 제7조의3(업무지원인 서비스 제공대상자의 선정 등)

Enforcement Decree of the Act on Promotion of Business Activities of Persons with Disabilities, Article 7-3 (Selection of Recipients of Work Assistant Services, etc.)

① 법 제10조의3제1항에 따른 서비스(이하 "업무지원인 서비스"라 한다)는 「장애인고용촉진 및 직업재활법」 제2조제2호에 따른 중증장애인으로서 근로자를 사용하지 않는 장애경제인(이하 "중증장애경제인"이라 한다) 중 기업 경영능력을 갖추었으나 장애로 인하여 기업경영에 어려움을 겪고 있는 사람을 대상으로 한다.

② 업무지원인 서비스의 업무지원 범위는 다음 각 호와 같다.

4. 그 밖에 중소벤처기업부장관이 필요하다고 인정하는 사항

③ 업무지원인 서비스를 받으려는 중증장애경제인은 중소벤처기업부장관이 정하여 고시하는 업무지원인 서비스 신청서 및 첨부서류를 중소벤처기업부장관에게 제출해야 한다.

④ 중소벤처기업부장관은 제3항에 따른 신청을 받은 경우 해당 중증장애경제인의 사업 내용과 경영 능력 등을 평가하여 업무지원인 서비스 대상자를 선정한다. 이 경우 다음 각 호의 중증장애경제인을 우대해야 한다.

⑤ 중소벤처기업부장관은 제4항에 따라 업무지원인 서비스 제공대상자로 선정된 중증장애경제인에게 예산의 범위에서 중소벤처기업부장관이 정하는 시간 동안 업무지원인 서비스를 제공하며, 그 소요 비용의 일부를 중증장애경제인에게 부담하게 할 수 있다.

⑥ 중소벤처기업부장관은 업무지원인 서비스 제공대상자로 선정된 중증장애경제인이 다음 각 호의 어느 하나에 해당하는 경우에는 업무지원인 서비스 제공대상자 선정을 취소하고 업무지원인 서비스의 제공을 중단할 수 있다. 다만, 제1호에 해당하는 경우에는 업무지원인 서비스 제공대상자 선정을 취소하고 업무지원인 서비스의 제공을 중단해야 한다.

1. 거짓이나 그 밖의 부정한 방법으로 업무지원인 서비스 제공대상자로 선정된 경우

⑦ 제1항부터 제6항까지에서 규정한 사항 외에 업무지원인 서비스 제공대상자의 선정 절차 등 업무지원인 서비스 제공에 필요한 사항은 중소벤처기업부장관이 정하여 고시한다.
