장기등 이식에 관한 법률 제38조의2(자료 요구)

국립장기이식관리기관 또는 장기구득기관의 장은 제12조에 따른 장기등의 기증에 관한 동의 확인, 제14조제1항 단서에 따른 장기등기증자가 뇌사자 또는 사망한 자인 경우 가족 또는 유족 확인, 제22조에 따른 장기등의 적출에 관한 동의 확인을 위하여 필요한 경우 「가족관계의 등록 등에 관한 법률」 제3조에 따른 시ㆍ읍ㆍ면의 장에게 같은 법 제15조에 따른 증명서의 교부를 신청할 수 있고, 법원행정처장에게 같은 법 제11조제4항에 따른 전산정보자료를 요청할 수 있다. 이 경우 신청 또는 요청을 받은 자는 정당한 사유가 없으면 이에 따라야 하며, 국립장기이식관리기관 또는 장기구득기관의 장에게 제공하는 자료에 대하여는 사용료 또는 수수료 등을 면제한다.
