Enforcement Decree of the Persistent Pollutants Management Act, Article 24 (Delegation of Authority)
① 기후에너지환경부장관은 법 제31조제1항에 따라 다음 각 호의 권한을 국립환경과학원장에게 위임한다. <신설 2023.6.7, 2025.10.1>
(1) Pursuant to Article 31 (1) of the Act, the Minister of Climate, Energy and Environment shall delegate the following authority to the Director of the National Institute of Environmental Research:
1. 법 제19조의2제1항에 따른 측정분석 전문기관의 지정
1. Designation of specialized measurement and analysis institutions under Article 19-2 (1) of the Act;
2. 법 제19조의2제2항에 따른 측정분석 전문기관의 지정 신청의 접수
2. Receipt of applications for designation of specialized measurement and analysis institutions under Article 19-2 (2) of the Act;
3. 법 제19조의2제3항에 따른 측정분석 전문기관의 변경지정
3. Change of designation of specialized measurement and analysis institutions under Article 19-2 (3) of the Act;
4. 법 제19조의2제4항에 따른 측정분석 전문기관의 지정취소 및 업무정지명령
4. Revocation of designation and orders for suspension of business of specialized measurement and analysis institutions under Article 19-2 (4) of the Act;
5. 법 제19조의2제5항에 따른 측정분석 전문기관의 지정ㆍ변경지정ㆍ지정취소ㆍ업무정지명령에 관한 공고
5. Public announcement of designation, change of designation, revocation of designation, and orders for suspension of business of specialized measurement and analysis institutions under Article 19-2 (5) of the Act.
② 기후에너지환경부장관은 법 제31조제1항에 따라 다음 각 호의 권한을 유역환경청장 또는 지방환경청장(이하 "지방환경관서의 장"이라 한다)에게 위임한다. <개정 2017.3.27, 2019.4.9, 2023.6.7, 2025.10.1>
(2) Pursuant to Article 31 (1) of the Act, the Minister of Climate, Energy and Environment shall delegate the following authority to the Director of a Basin Environmental Office or Regional Environmental Office (hereinafter referred to as the "head of a regional environmental office"):
1. 법 제13조제5항에 따른 예외적 취급허용 잔류성오염물질 또는 취급제한 잔류성오염물질의 수출에 대한 승인
1. Approval of export of persistent pollutants permitted to be handled by exception or persistent pollutants subject to handling restrictions under Article 13 (5) of the Act;
2. 법 제16조 및 제30조에 따른 개선명령, 사용중지명령, 폐쇄명령 및 그 폐쇄명령에 관한 청문
2. Orders for improvement, orders for suspension of use, and orders for closure under Articles 16 and 30 of the Act, and hearings concerning such closure orders;
2의2. 법 제16조제4항에 따른 행정처분의 공표
2-2. Publication of administrative dispositions under Article 16 (4) of the Act;
3. 법 제17조에 따른 과징금의 부과ㆍ징수
3. Imposition and collection of penalty surcharges under Article 17 of the Act;
4. 법 제19조제2항에 따른 주변지역 영향조사 결과의 접수
4. Receipt of results of surrounding area impact surveys under Article 19 (2) of the Act;
5. 법 제19조제3항에 따른 잔류성오염물질의 측정 또는 영향조사 명령
5. Orders for measurement of persistent pollutants or impact surveys under Article 19 (3) of the Act;
6. 법 제19조제4항 및 제30조에 따른 배출사업자에 대한 배출시설의 사용중지명령, 폐쇄명령 및 그 폐쇄명령에 관한 청문
6. Orders for suspension of use and orders for closure of emission facilities against emission business operators under Article 19 (4) and Article 30 of the Act, and hearings concerning such closure orders;
7. 법 제20조제2항에 따른 신고의 수리
7. Acceptance of reports under Article 20 (2) of the Act;
8. 법 제20조제3항에 따른 조치명령
8. Orders for measures under Article 20 (3) of the Act;
8의2. 법 제23조제3항 및 제30조에 따른 잔류성오염물질함유폐기물을 재활용하려는 자에 대한 해당 시설의 사용중지명령, 폐쇄명령 및 그 폐쇄명령에 관한 청문
8-2. Orders for suspension of use and orders for closure of the relevant facilities against persons who intend to recycle waste containing persistent pollutants under Article 23 (3) and Article 30 of the Act, and hearings concerning such closure orders;
9. 법 제29조제1항에 따른 보고명령, 자료제출명령, 시료채취 및 검사
9. Orders for reporting, orders for submission of data, and collection of samples and inspection under Article 29 (1) of the Act;
10. 위임된 사항에 관한 법 제37조에 따른 과태료의 부과ㆍ징수
10. Imposition and collection of administrative fines under Article 37 of the Act regarding delegated matters.
